Gisteren publiceerde de Financial Times een open brief van een groot aantal professoren onder de titel: Ireland should recuse itself from key EU negotiations. Eerste ondertekenaar is professor Shoshana Zuboff, bekend van haar boek: The Age of Surveillance Capitalism: The Fight for a Human Future at the New Frontier of Power. Als je je afvraagt waar dit heen gaat dan raad ik je aan om eerst even De Autoriteit Persoonsgegevens kan altijd nog naar Ierse DPA wijzen, met deze observatie:

[Europarlementariërs] Schwab en Arias winden er geen doekjes om; Ierland’s voorzitterschap van de EU is een gevaar voor (onder meer) de GDPR en AI Act. En dat heeft alles te maken met met de Ierse toezichthouder DPC (Data Protection Commission)

Ik vind de brief lezenswaardig en een signaal aan Ierland en andere Europese landen om zich bewust te zijn van haar verantwoordelijkheid bij het beschermen van burgers tegen een ongekende en steeds meer ongebreidelde macht van Amerikaanse tech-giganten:

Ireland took over the rotating presidency of the Council of the European Union on July 1. During this six-month period, Europe will renegotiate its digital rule book and its corporate tax rules. As council president, Ireland will chair these negotiations and decide what matters are discussed.

Given Ireland’s questionable record regarding the protection of EU digital rights […], we the undersigned call on Ireland to recuse itself from any role in [this area] […] during the Irish presidency of the European Union.

Google, Meta, Apple, Microsoft, OpenAI, TikTok, and X all selected Ireland to be the location of their EU headquarters. This turned the Irish Data Protection Commission into the primary data watchdog for the EU.

This responsibility has not been matched by effective enforcement. After 10 years of the General Data Protection Regulation (GDPR), Ireland has yet to conclude a single EU-wide inquiry into Google. In 2023, Ireland took the extraordinary step of suing every other EU data protection authority at EU court in Luxembourg, seeking an annulment of an order that mandated Ireland to investigate Meta’s use of people’s most intimate data.

Recent developments also raise questions about the independence of Ireland’s digital governance. The current data protection commissioner previously served as Meta’s chief lobbyist in Ireland. Additionally, in the run-up to the presidency, foreign minister Helen McEntee posed with a Meta lobbyist, following their meeting to discuss priorities for Ireland’s upcoming presidency.

In short, Ireland’s reliance upon giant non-EU firms creates insurmountable conflicts of interest, as evidenced by the country’s record in the area of data regulation […].

We expect that Ireland will recuse itself from any role in these two areas during its presidency and as a practical matter, we propose therefore that the renegotiation of any relevant files is run by the next country in line for the presidency — Lithuania.

Gaat natuurlijk niet gebeuren, want sinds wanneer luistert een overheid naar verontruste burgers die geen oligarch zijn? Maar ik vind het wel een hoopvol signaal dat de wetenschappelijke wereld in ieder geval haar stem luid en duidelijk laat horen.
