Lees even onderstaande snippet uit een artikel in The Washington Post van 3,5 jaar geleden:

[…] Clearview AI is telling investors it is on track to have 100 billion facial photos in its database within a year, enough to ensure “almost everyone in the world will be identifiable,” […] Those images — equivalent to 14 photos for each of the 7 billion people on Earth — […]. And the company wants to expand beyond scanning faces for the police, saying […] that it could monitor “gig economy” workers and is researching a number of new technologies that could identify someone based on how they walk, detect their location from a photo or scan their fingerprints from afar.

Komt het ontbijt/lunch/avondeten (doorhalen wat niet van toepassing is) al naar boven? Dan ben ik gelukkig niet de enige. Welkom in 1984.

Nu is Clearview AI geen onbekende partij binnen Europa, er zijn zelfs meerdere Europese Data Protection Agencies (waaronder de Autoriteit Persoonsgegevens) die boetes hebben opgelegd ter waarde van een slordige EUR 100 miljoen. De Oostenrijkse DPA heeft Clearview AI in de ban gedaan zonder daar een boete aan te verbinden. Maar vervolgens werd het stil, doodstil. Sinds medio 2024 is er geen kik meer gehoord van de verzamelde DPA’s in Europa terwijl de wereld rondom privacy natuurlijk volledig op haar kop werd gezet met Trump’s AMERICA’S AI ACTION PLAN, waarin de rechten en bescherming van de burger een afterthought is geworden.

Maar gelukkig is daar het kleine Gallische dorpje waar privacy nog altijd hoog in het vaandel wordt gevoerd. Jawel, ik heb het over noyb (none of your business) die vandaag het volgende lieten weten:

Today, noyb has filed a criminal complaint against Clearview AI and its managers. […] Several EU data protection authorities have already imposed fines and bans on Clearview AI. But the US company simply ignores these actions – given the lack of enforcement. […] EU data protection authorities did not come up with a way to enforce its fines and bans against the US company, allowing Clearview AI to effectively dodge the law.

However, EU law is not limited to administrative fines under the GDPR. Article 84 GDPR also allows EU Member States to foresee criminal sanctions for GDPR breaches. […] In contrast to GDPR violations, criminal violations also allow actions to be taken against managers and to use the full range of criminal procedures, including EU-wide actions. For that reason, noyb now filed a criminal complaint with the public prosecutors in Austria. If successful, Clearview AI and its executives could face jail time and be held personally liable, in particular if traveling to Europe.

Het klinkt een beetje als David en Goliath, maar kijk eens waar geitenpaadjes uiteindelijk Rutte hebben gebracht…
