Ik heb twee weken geleden een aantal vragen opgestuurd naar de DPO’s/FG’s van Indeed, Stepstone, Totaljobs en Seek. Ondertussen heb ik ook nog een enigszins uitgebreidere vragenlijst opgestuurd naar de Benelux baas van Indeed, maar daarover een andere keer meer. Vandaag heb ik een eerste antwoord ontvangen, van Totaljobs. Ik tel dan de volstrekt overbodige bevestigingsmailtjes van Stepstone niet mee, want hier wordt tenslotte geen enkel antwoord gegeven:

Dit zijn overigens de vragen die ik in eerste instantie aan elk van de vacaturesites heb gesteld:

1. When a job seeker applies to a job via Totaljobs , is the subsequent disposition data subsequently linked to this job seeker? If this is correct, does this mean that disposition data Totaljobs collects via its site and via a partner ATS is always linked to individual job seekers (ie the profile a job seeker has on Totaljobs)?
2. What is the default setting in your API with the partner ATS: opt-in or opt-out (of the disposition data delivery)?
3. Does Totaljobs validates that partner ATS’s inform their clients of the consequences of opting in or out of the disposition data delivery? If so, how? How is made sure that the client is fully aware of the consequences? Do you have a template to assist partners in this process? 
4. If a job seeker applies through the web site of a ATS partner client AND the ATS partner opt-in is active, what data do you receive (if any)?
5. How are job seekers informed of the fact that their disposition data might end up with Totaljobs? If so, how? How is made sure that the job seeker is fully aware of the consequences? Do you have a template to assist partner ATS’s and their clients?
6. Are partner ATS (and/or ATS clients) incentivized for the delivery of disposition data? If so, is this only for job seekers that originate from Totaljobs, only for job seekers that come via de partner client’s website or both?

Totaljobs reageert!
Dit is het antwoord dat ik kreeg van Totaljobs, van een Job Compliance Consultant. Ik heb geen idee wat een Job Compliance Consultant doet, maar het lijkt me niet dat deze zich met disposition data bezig houdt…

Many employers voluntarily share application‑status updates (status information) with us so jobseekers can clearly see where they stand in each hiring process. Whether status information is sent depends on the customer. We only display status information for registered jobseekers and only when we receive them from the customer, as this is part of our contractual commitment to job seekers. To clarify, ATSs do not provide us with status information about jobseekers who are not registered with Totaljobs.  We introduced status information because jobseekers consistently report frustration about not receiving updates. The information is used to inform jobseekers and is covered by our Terms and Privacy Policy. No party in the process is incentivized to share personal data — customers simply understand that jobseekers value clear updates on their application progress.

Totaljobs positioneert het fenomeen disposition data als een service (jobseekers consistently report frustration about not receiving updates). De Privacy Policy van Totaljobs spreekt over Application status, dit is synoniem met disposition data:

Application status: information about the application sent by the recruiter (For example, Application received, Qualified, Hired and/or Rejected).

In de Totaljobs’ Terms and Conditions staat het volgende:

6.2.3. We will also share your application history (jobs you have applied for and when you applied for them) unless you tell us not to. You can change this at any time.
6.11.1 As part of our contractual obligation, we will inform you about the status of your submitted application(s) for a job offer posted on our websites based on the recruiter’s activity. This will include a summary of the status of the submitted application(s). We will only provide this information if the recruiter permits us to provide such information. This will include but shall not be limited to the receipt of the application or the opening of the application, you may find the details about your application status within your account.

Totaljobs biedt inderdaad een mogelijkheid om aan te geven dat je geen disposition data wil delen. De mogelijkheid staat in de accountinformatie van een gebruiker en staat default aan… Natuurlijk… O ja, deze toggle staat ook below the fold dus als het even meezit, ziet de werkzoeker deze optie nooit:

Ik ben nu overigens ook serieus in de war. In bovenstaand scherm zegt de toggle:

Allow recruiters to see your application history. Recruiters can see the jobs you’ve applied for on Totaljobs over the past 12 weeks. This helps them get a clearer picture of your career interests and offer relevant job opportunities.

Welke sollicitant wil dat recruiter x/y/z al zijn/haar/x sollicitaties zien? Waarom zou je je sollicitatie-activiteiten willen broadcasten? Ik hoop dat iemand dat wel snapt en mij hierover bijlicht. Want mijn boomer verstand zegt me dat solliciteren een solitaire activiteit is en zeker geen theekransje.’

Terug naar disposition data, de Privacy Policy heeft het over:

Application status: information about the application sent by the recruiter (For example, Application received, Qualified, Hired and/or Rejected).

Nu is Totaljobs primair een Engelse site, en sinds de Brexit gaat het niet echt lekker meer met de Britse economie. Maar het zal toch niet zo slecht geregeld zijn dat Britse recruiters naar Totaljobs mailen, iedere keer dat er een statusverandering in het sollicitatieproces optreedt? Dus dat recruiterverhaal in de Privacy Policy is onzin, dat moet via een ATS verlopen, tenzij Totaljobs een side hustle heeft als ATS.
